In India, creating an affidavit or HUF deed is considered the first and most important step in the process of forming and registering a Hindu Undivided Family (HUF).   • The main character and key person of the affidavit being made for the HUF is the Karta.
  • The name of the Karta, the father’s name, age, and address are mainly mentioned in the format of an affidavit for HUF PAN Card.
  • An HUF is addressed by the name of its Karta. The name of the HUF is mentioned in the affidavit. The word “HUF” is added to the name of the Karta in the affidavit; this forms the name of the HUF.
  • A table is created in the affidavit format, and the names of all the members and coparceners of the HUF, their father’s name, address, and their relationship with the Karta are mentioned in it.
  • The identity number (PAN or Aadhaar) of all members and coparceners is mentioned in the affidavit for HUF PAN Card.
  • According to Hindu Law, the date of marriage of the Karta is considered as the date of incorporation of the HUF, which is mentioned in the affidavit. This same date is also recorded on the PAN Card of the HUF.
  • A statement by the Karta stating that the information is true and correct to the best of their knowledge and belief, and that nothing material has been concealed.
  • The place and date of signing the affidavit are mentioned in the format.

  • In most states of India, stamp paper is required for an affidavit for the HUF PAN Card under Article 4 of the Schedule of the Indian Stamp Act, 1899.
  • The Karta alone has the authority and responsibility to sign the stamp paper and affidavit for HUF PAN card.

DECLARATION-CUM-AFFIDAVIT FOR HUF PAN CARD

I, [Name of the Karta], son of Shri [Name of the Father], aged [Age] years, residing at [Proper Address as per proof], and as Karta of my Hindu Undivided Family (HUF) affirm on oath and declare as under:

  1. That I am the Karta of my Hindu Undivided Family (HUF), known as [Name of Karta] HUF governed by Hindu Law.

  2. That the said Hindu Undivided Family has been in existence since [the date of marriage of the Karta (in the format DDMMYYYY)] and continues to exist as a Hindu Undivided Family governed by Hindu Law.

  3. That as on today, name of coparceners/members (including name of Karta) of our above said HUF, their

    (a) [Member/Coparcener 1 Name]     – Father Name – Address – Aadhaar/PAN No. – Relation with Karta
    (b) [Member/Coparcener 1 Name] – Father Name – Address – Aadhaar/PAN No. – Relation with Karta

  4. That, apart from the persons mentioned above, no other coparcener/member exists in the said HUF, nor does anyone else have the right to make any kind of claim.

  5. That the Karta is fully authorized to open, operate, and close bank and demat accounts in the name of the HUF, apply for and manage PAN of the HUF, file Income-tax returns, replies, appeals, and representations, apply for GST registration, MSME (Udyam) registration, and other statutory registrations, sign cheques, applications, agreements, and all documents on behalf of the HUF.
